Batteries Accessoires is part of the L'Oréal Malaysia Sdn Bhd (199401042730 [328418-A]) ("L'Oréal", "our", "we" or "us") portfolio of brands. L'Oréal is responsible for the personal data you share with us. L'Oréal is the "data controller" for the purposes of the Malaysian Personal Data Protection Act 2010 (Act 709) and applicable data protection laws in relevant jurisdictions.

2. What is Personal Data?
“Personal Data” means any information or piece of information that identifies you directly (such as your name) or indirectly (such as through pseudonymous data such as a unique ID number) and/or that can identify you. This means Personal Data includes email/home address/mobile number, username, profile picture, personal preferences and shopping habits, user-generated content, financial information and benefits information. In some cases, it may also include unique digital identifiers such as your computer’s IP address or your mobile device’s MAC address, and cookies.

At L’Oréal, we believe that you – the consumer – are at the heart of what we do. We love to listen to you, understand your needs and create and deliver products you love. We also know that many of you like to communicate with us. Therefore, you may share your Personal Data with us in a variety of ways, and we may collect it in a variety of ways.
(i) How do we collect or receive your data?
We may collect, record, hold, store, use, disclose, receive and/or process (collectively, “Process”) your data through our websites, forms, applications, devices, L’Oréal products or brand pages on social media or otherwise. Sometimes you provide this data to us directly (e.g. when you create an account, contact us, make a purchase on our websites/applications or in stores/salons); sometimes we collect this data (e.g. using cookies to understand how you use our websites/applications); and sometimes we receive your data from other third parties (including other entities in the L’Oréal Group).
When we collect data, we will indicate mandatory fields with an asterisk, which are necessary for us to:
Perform our contract with you (e.g. deliver the products you purchased on our websites/applications);
Provide you with the services you requested (e.g. provide you with newsletters);
Comply with legal obligations (e.g. invoices, e-invoices); or
Perform the issuance and/or validation of e-invoices, including processing subsequent/related tax matters for the Inland Revenue Board of Malaysia (“IRBM”) requirements;

(ii) Automated decision making
In order to protect transactions conducted through our website/application/device from fraud and misappropriation, we use solutions from third-party providers. Fraud detection methods are based on, for example, simple comparisons, associations, clustering, predictions and outlier detection using intelligent agents, data fusion techniques and various data mining techniques.
This fraud detection process may be fully automated or may involve human intervention, with decisions ultimately made by humans. In any case, we take all reasonable precautions and safeguards to limit access to your data.
Due to automated fraud detection features, you may (i) experience delays in order/request processing while we review your transaction; and (ii) you may be restricted or excluded from the service if a risk of fraud is identified. (iii) Profiling
When we send or display personalized communications or content, we may use some technologies known as “profiling” (i.e. any form of automated processing of personal data that involves the use of that data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects relating to that natural person’s personal preferences, interests, economic situation, behavior, location, health, reliability or movements). This means that we may collect your personal data in the different scenarios mentioned in the table above. We aggregate this data and analyze it to evaluate and predict your personal preferences and/or interests.
Based on our analysis, we may send or display communications and/or content that match your interests/needs.

(iv) Who has access to your personal data?
We may share your personal data within the L’Oréal Group to comply with our legal obligations, prevent fraud and/or protect our tools, improve our products and services, or with your consent.
Depending on the purpose for which the information was collected, and only on a need-to-know basis, L’Oréal Group entities worldwide may have access to some of your personal data in a pseudonymised form (not allowing direct identification) and as necessary to provide you with the services you requested.
We may also share your personal data in a pseudonymised form (not allowing direct identification) with L’Oréal Research & Innovation scientists, including those located outside your country, for research and innovation purposes.
Where permitted, we may also share some of your personal data, including data collected through cookies, across our brands to coordinate and update the information you share with us, generate statistics based on your characteristics and tailor our communications.

We share your personal data with third parties for direct marketing purposes only with your consent. In such cases, your data will be processed by that third party as the data controller and its own terms and conditions and privacy notice will apply. You should read their documentation carefully before agreeing to disclose your information to such third party.
Our trusted third-party providers (whether in or outside Malaysia) may also process your personal data on our behalf.
We rely on trusted third parties to perform a range of business operations on our behalf. We only provide them with the information they need to perform the service and require them not to use your personal data for any other purpose. We always do our best to ensure that all third parties we work with keep your personal data secure. For example, we may entrust services that require the processing of your personal data to:

Third parties that assist us with issuing and/or verifying e-invoices, handling subsequent/related tax matters (including providing necessary services in connection with this) as part of our compliance with the Inland Revenue Board’s (IRBM) legal requirements.

If we sell any business or assets, we may disclose your personal data to the prospective buyer of that business or assets. If L'Oréal or some of its assets are acquired by a third party, personal data held by L'Oréal about its customers in relation to those assets will be considered part of the transferred assets. In such event, the buyer will be the new data subject.The Privacy Policy will govern the processing of your personal data.
If we are under a duty to disclose or share your personal data to comply with a legal obligation, including but not limited to e-invoicing purposes as required by the IRBM, or to enforce or apply our Terms of Use/Sales or other terms and conditions you have agreed to; or to protect the rights, property or safety of L’Oréal, our customers or employees.

If you subscribe to a service that is jointly created by L’Oréal and a partner (e.g. a co-branded application). In this case, L’Oréal and the partner will each process your personal data for their own purposes and therefore, your data will be processed in the following ways:

The partner also acts as a data controller in accordance with its own terms and conditions and its own privacy policy.
If you have agreed to receive marketing and commercial communications from L’Oréal’s partners through a dedicated subscription (e.g. through an application under a L’Oréal brand and open to its partners), in this case, your data will be processed by the partner as a data controller in accordance with its own terms and conditions and privacy policy. We may publish content from social networks on our supported platforms. If you consult content from social networks on our website/app, cookies from such social networks may be stored on your device. Information Facebook collects and shares with us
All Facebook features and services available on our website/app are subject to the Facebook Data Policy, where you can get more information about your privacy rights and setting options.

The data we collect from you may be processed, transferred, accessed and stored at destinations outside Malaysia. The data may also be processed by our staff or those of our service providers working outside Malaysia.
L’Oréal transfers personal data outside Malaysia only in a secure and lawful manner. As some countries may not have laws regulating the use and transfer of personal data, we take steps to ensure that third parties adhere to the commitments set out in this Policy. We will only retain your personal data for as long as is necessary for the purposes for which we hold it, to fulfill your request or to comply with our legal obligations.
To determine how long we retain your data, we use the following criteria as a guide:
When you purchase products and services, we retain your personal data for the duration of the contractual relationship;
When you participate in a promotion, we retain your personal data for the duration of the promotion;

When you create an account, we retain your personal data until you ask us to delete it or after a period of inactivity (no active interaction with the brand) as defined by local regulations and guidance;

We are committed to keeping your personal data secure and take all reasonable precautions. We contractually require trusted third parties who process your personal data to do the same.
We always do our best to protect your personal data and once we have received your personal data, we use strict procedures and security features to try to prevent unauthorized access. As the transmission of information via the internet is not completely secure, we cannot guarantee the security of your data transmitted to our site. Therefore, any transmission is at your own risk.

Our website and applications may, from time to time, contain links to the websites of our partner networks, advertisers and affiliates. Some of our websites and applications allow users to submit their own content.
